衝突礦產聲明 HITEK Conflict Minerals Statement

美國證管會(Securities and Exchange Commission, SEC) 於2012年8月22日,通過了「Dodd-Frank華爾街改革與消費者保護法」第1502條中,有關採購「衝突礦產」的最終版條文。這項條文,約束了例如HITEK的美國上市公司,需合理質疑,並根據情況,更積極地實質審查產品的材料來源與產銷監管鏈(chain of custody)中,是否含有衝突礦產;也需每年公開報告衝突礦產是否有來自於、或成為剛果民主共和國(Democratic Republic of Congo)及鄰近國家非法武裝組織的收入來源。條文中提到的衝突礦產包含:鈳鉭鐵礦(Tantalum)、錫石(Tin)、黑鎢(Tungsten)以及黃金(Gold)。HITEK雖然沒有直接向供應商購買礦產,但自供應商買進的零件確實含有金屬,而這些金屬中可能來自於剛果民主共和國與其鄰近國家的礦產。
 
 
HITEK的對策
HITEK與同業一致,支持整條供應鏈都需履行社會責任的想法。為表行動,HITEK一直关注電子行業公民聯盟(Electronic Industry Citizenship Coalition, EICC),此聯盟的優點為,相較起單一家企業孤軍奮戰,在聯盟內,多家企業可聯合針對此議題,更有策略且全面地分析並喚起注意。
 
針對每一項衝突礦產,EICC都會主動召集聯盟會員,並討論在追溯各產銷監管鏈中的礦產時面臨的挑戰。在與「全球永續議題e化倡議組織」(Global e-Sustainability Initiative, GeSI)的合作下,EICC投注相當多資源,開啟了「無衝突礦產冶煉廠」(Conflict-Free Smelter, CFS)專案,以協助確認冶煉廠與精煉廠都有能力辨識將使用於電子產品中的材料來源。此外,EICC與GeSI也共同草擬了「EICC/GeSI衝突礦產調查表」(EICC/GeSI Conflict Minerals Reporting Template),以標準化自所有供應商蒐集資訊的方式。
 
HITEK現正將這份調查表寄給供應商,並請他們提供供應鏈中冶煉廠與精煉廠的情報。除此之外,HITEK目前也在與供應商的正式合約及供應商指導手冊裡,加入以下內容已要求供應商─1)執行對進料來源負責的政策;2)執行支持該政策的實質審查;3)填妥並回執「EICC/GeSI無衝突礦產調查表」給HITEK。
 
對供應商的期待
HITEK 在此要求供應商配合以下所有事項:
 
- 執行對進料來源負責的政策,並將此政策貫徹於整條供應鏈中;
- 執行支持該政策的實質審查;
- 只從有確實履行社會責任的來源購買材料;以及準時填妥並回執「EICC/GeSI衝突礦產調查表」給HITEK,並在HITEK提出要求時,提供出貨至HITEK之材料來源的各項情報。
若是HITEK發現有供應商不能配合以上事項,HITEK將會採取必要行動以修正此情形,包含重新審核供應商等。

We are writing to you about important U.S. federal legislation which affects the electronics and other manufacturing industries.  To fully comply with the law and accompanying regulations, we will need your help.
 
 
On August 22, 2012, the U.S. Securities Exchange Commission (SEC) issued a final rule pursuant to section 1502 of the Dodd-Frank Act.  The rule requires businesses that file with the SEC and manufacture products that contain tin, tantalum, tungsten, and gold to report whether the minerals originated in the Democratic Republic of the Congo or an adjoining country and, if so, to report whether these conflict minerals benefit or finance armed groups in these countries.
 
 
While HITEK is not required to report to the SEC, HITEK expects our suppliers to source materials from socially responsible suppliers and to avoid the use of conflict minerals. Accordingly, HITEK is soliciting information from its suppliers concerning the use of Conflict Minerals in their products.
 
 
HITEK’s initiative is consistent with the efforts of the Electronic Industry Citizenship Coalition (“EICC”) and Global e-Sustainability Initiative (“GeSI”).  Accordingly, we are requesting that all of our electronic suppliers complete the attached EICC GeSI Conflict Minerals Reporting Template.  Please review the form and answer all the questions.
